DEFINITIONS

In the content of this document, the following terms used in uppercase letters will have, unless the context indicates otherwise, the meanings specified below:

REGISTERED TRADEMARKS: Represents the registered trademarks of MINCOS CONCEPT SRL, such as, but not limited to, the name FIJI TRAILERS.

SITE: Represents the Internet SITE belonging to MINCOS CONCEPT SRL, which is located at www.fijitrailers.com, through which the USER has access to information regarding the services and products offered/ensured by FIJI TRAILERS in the FIJI TRAILERS network.

FIJI TRAILERS: Represents the company MINCOS CONCEPT SRL, with headquarters at Strada Agricultorilor no. 6, Mogoșoaia, Ilfov, Romania, registered at the Trade Register under no. J40/12105/25.08.2018 and having the Unique Registration Code RO39789326.

USER: Represents the person who accesses the SITE, for private or professional purposes, and who has accepted the TERMS AND CONDITIONS of this SITE, fulfilling all the requirements of the registration process or a visitor to the site who is not registered/logged in.

ABUSIVE USE: Represents the use of the SITE in a manner contrary to the practice in the field, the regulations, and the legislation in force, or in any other way that may cause damage to MINCOS CONCEPT SRL.

CONTENT OF THE SITE

2.1. The information published on the SITE is of general interest about FIJI TRAILERS, the products commercialized by it, information about its partners, and other information considered by FIJI TRAILERS to be of interest to USERS.

2.2. The information is made available to USERS, generally, free of charge. FIJI TRAILERS reserves the right to implement certain services on the SITE that will be offered to USERS for a fee.

2.3. FIJI TRAILERS is the owner of all intellectual property rights on the SITE, respectively on its design and content as well as on all the Registered Trademarks of FIJI TRAILERS published on the SITE. The USER is obliged to respect all intellectual property rights of FIJI TRAILERS, provided by the legislation in force.

USE OF THE SITE

3.1. The USER undertakes to access and use the SITE for purposes and by means that do not constitute abusive use.

LIMITATION OF LIABILITY OF MINCOS CONCEPT SRL

4.1. Liability for the content of the SITE. FIJI TRAILERS is not and cannot be held responsible for the damages created by errors, inaccuracies, or non-updating of the information published or maintained on the SITE, which are not due to its fault. USERS can find detailed information in the network of collaborating firms of FIJI TRAILERS.

4.2. If the prices or other details regarding the products/promotions have been displayed incorrectly, including due to the fact that they have been incorrectly entered in the database, we reserve the right to cancel the order/pre-order/delivery of the respective product and to notify the client by phone/email as soon as possible about the error that occurred, if the product has not yet been delivered.

4.3. The characteristics of the products presented on the SITE are taken/provided by the manufacturers, suppliers, and FIJI TRAILERS does not assume responsibility for the correctness of this information.

4.4. The prices of the products on this SITE are informative and may suffer unannounced changes, especially for products in the categories Commercial Trailers, Car Trailers, products that are made to order/personalized. The promotions presented on the SITE are valid for the period mentioned. If a time period is not mentioned, they are valid within the limits of available stocks. The prices displayed on the SITE are not always identical to those in the network of FIJI TRAILERS sites/stores, so differences may occur between the price of the product displayed on the SITE and that displayed in the network of FIJI TRAILERS stores. Orders whose products ordered on the SITE have a lower price than that displayed in FIJI TRAILERS stores remain valid and will be honored in the order of their registration on the SITE and depending on the available stock limit for each product in the order. All products presented on this SITE are available within the limit of the physical stock available. If the stock is exhausted, the order will be canceled, the customer being notified in this respect by a representative of FIJI TRAILERS. For paid orders, the equivalent value will be refunded to the account from which the payment was made.

4.5. Also, the images are presented on the SITE as an example, and the delivered products may differ from the images in any way due to the modification of the characteristics or design, without prior notification by the manufacturers.

4.6. A product on pre-order, in the categories Commercial Trailers, Car Trailers, is a product that will be built/made in our facilities. FIJI TRAILERS reserves the right to modify the availability date without notice. Pre-order products are added to the cart in the same way as any other product from the online store. By making a pre-order, you ensure that you will receive the product immediately after construction and that you will benefit from a very good price. The products on pre-order will be delivered in an estimated term of 21 working days but no later than 30 days. In the event that the product from the categories Commercial Trailers or Car Trailers is in stock, the delivery will be made in approximately 8 working days, this time being conditioned by the RAR approval processes. Pre-orders in the categories Commercial Trailers and Car Trailers are paid in the same way as a normal order (the client having the possibility to pay 50% of the product value upon signing the contract), through any of the accepted payment methods. You can cancel a pre-order at any time if the advance payment has not been collected, once the advance has been collected, the order can no longer be canceled. See the Return Policy.

4.7. FIJI TRAILERS reserves the right to complete and modify any information on the SITE.

4.8. Any problem caused by the products and/or services presented on the SITE will be resolved amicably within 15 working days from the date of the written notification of the issues by the USER.

LOSSES/ADDITIONAL COSTS

FIJI TRAILERS is not responsible for any loss, costs, claims, expenses, or other liabilities if they are directly caused by non-compliance with the Terms and Conditions.
5.1. FIJI TRAILERS is not responsible for damages caused by the malfunction of the SITE as well as for those resulting from the impossibility of accessing certain links published on the SITE.

5.2. FIJI TRAILERS is not responsible for technical malfunctions of the network/equipment belonging to mobile phone operators/payment processors, etc.

USE OF THE INTERNET BROWSER

FIJI TRAILERS guarantees the optimal use of the SITE by using at least Internet Explorer 6.
6.1. We inform you that any complaints regarding the aesthetic deficiencies of the products will be taken into account and will be analyzed only if they are reported within the first 48 hours from the receipt of the product.

6.2. The payment methods for completing an online order are: cash on delivery, online with a bank card, bank transfer. For orders registered with the payment method “cash on delivery,” a unique order processing cost of 5 lei is added, which will be highlighted separately in the shopping cart and on the fiscal invoice.

6.3. The processing cost of orders registered with the payment method “cash on delivery” is independent of the cost associated with the delivery of the products, which takes into account the final value of the order, this being not taken into account. 6.4. The registration of the order does not represent its confirmation. After taking over the order, it will be processed by our operators for confirmation and establishing delivery details. The estimated delivery time for categories SHOP is 1-3 working days from the confirmation of the order, but no later than 15 days.

6.5. During the Easter holidays, winter holidays, Black Friday event, as well as throughout other company campaigns, processing an order as well as its delivery can take between 7-10 working days, but no more than 15 working days.

6.6. Upon purchasing products, please check the integrity and content of the package at the moment of receiving it. Any subsequent complaints will not be taken into consideration.

6.7. Delivery. The buyer has the right not to accept the goods delivered if they do not conform to the technical details specified on the product page. In this case, FIJI TRAILERS assumes the responsibility of bringing the products to conformity.

6.8. The buyer will own the goods after signing the transport document and making the payment (if it has not been made beforehand) to the courier.

6.9. In case of order cancellation, neither of the involved parties will claim/ask for damages.

6.10 Return of Products

According to OUG no. 34/2014, the buyer has the possibility to withdraw from the distance contract within 14 days starting from the day he takes physical possession of the product, except for products from the categories Commercial Trailers and Car Trailers made to order/pre-order.

You have the possibility within this term to return the product, not being mandatory to return it in the original packaging. For this, you can complete the return form made available in the section Return Form or you can communicate your intention (unequivocal statement) of return in any other way (in writing – envelope to the post, by email, by phone, etc.). In the return process, you can use any expedition service.

PRODUCTS NOT ACCEPTED FOR RETURN:

Products made to order, pre-order, personalized (pre-orders or orders made on the site or at the headquarters):
Products brought on special firm orders for which an advance payment was required;
Commercial trailers made/ordered to order/pre-order;
Car trailers made/ordered to order/pre-order;
Equipment for trailers/car trailers made/ordered by customized order from the manufacturer;
Interior/exterior fittings for trailers/car trailers made/ordered by customized order from the manufacturer;
Items that have been inscribed with certain texts or images;
Other services purchased online, etc.
Sealed products that cannot be returned for health protection reasons;
Products that show physical modifications, hits, chipping, scratches, mechanical or electrical shocks (not reported as aesthetic defects in the first 48 hours from receiving the product). Products that show physical modifications, hits, chipping, scratches, shocks, signs of excessive use and/or unauthorized interventions, etc., are not accepted for return.
Digital software products, digital licenses, and any alphanumeric digital activation codes for operating systems, applications, services, subscriptions, and digital wallets;
Unsealed cartridges, toners that are unsealed for return;
Printers/multifunctionals/fax machines that have unsealed cartridges/toners;
Supply of digital content that is not delivered on a material medium if the provision started with the prior express consent of the Buyer and after he confirmed that he has acknowledged that he will lose his right to withdraw;
If multiple products of the same model are purchased, only one unsealed or unpacked item will be accepted for return;
If a product from a promotional package is returned, the difference between the base price and the promotional price of the returned product will be returned.
Exceptions to the right of withdrawal are enumerated restrictively by law.

If a warranty certificate is issued for the product and non-compliance is found during the warranty period, the repair will be carried out in accordance with O.G. no. 21/1992, Law 449/2003, and other applicable legal provisions.

7. ACCESS TO THE SITE WWW.FIJITRAILERS.COM

This implies the USERS’ acceptance that their personal data will be stored and processed by the company FIJI TRAILERS. The information you transmit to us is treated with the utmost confidentiality and exclusively for the purposes for which it was collected.

The purposes of processing these data are: creating a user account for purchasing products, delivering ordered products, subscribing to our offers (user consent), sending commercial communications (user consent), sending offers for complementary products or accessories to purchased products (based on user consent and in the legitimate interest of MINCOS CONCEPT SRL or group companies), informing subscribed users about FIJI TRAILERS store promotions or any other promotions or activities conducted by FIJI TRAILERS through any means of communication (mail, email, phone, SMS, etc.), creating a database for generating statistical reports, etc. At the time of contact, the user will be informed about the purpose of the action for which he was contacted and his consent will be requested if that action involves the processing of his personal data and if his consent is needed for that.

MINCOS CONCEPT SRL is the sole owner of the information collected on this site. MINCOS CONCEPT SRL undertakes that personal data will not be disclosed to third parties through sale, partial disclosure, or rental.

MINCOS CONCEPT SRL may disclose your personal information to group companies or authorized third parties, with which the company has entered into various contracts, all validated by the Legal Department and followed by confidentiality agreements (Non-Disclosure Agreement) and/or personal data processing agreements (DPA). If the partnership involves the transfer of information and data about users, the partner will be obliged to respect the confidentiality of this data and to use it exclusively for the purpose of executing the respective contract. Partners can have the status of Data Controller-Person authorized to process personal data or can be Joint Controllers, jointly determining the purposes and means of data processing; in both cases, your data will be processed in accordance with the provisions of Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

If you choose to pay online with a bank card, FIJI TRAILERS will transmit to the payment processor only information related to your order, without accessing and processing other data related to the bank card.

Our partners offer products and services complementary to those purchased from FIJI TRAILERS stores and www.fijitrailers.com; based on these partnerships, your interactions with us, your choice to subscribe to the Newsletter, you may be contacted by representatives of: FIJI TRAILERS, Urgent Cargus SRL, or other subcontracted carriers if you chose to have the order delivered by courier, your data may also be accessed by companies providing (email) marketing services, advertising agencies, direct marketing operators who carry out specific actions agreed upon by FIJI TRAILERS, fixed or mobile telephone operators.

Any processing of your personal data will be done in compliance with the Privacy Policy.

8. DATA COLLECTION

It is done through various specific methods and tools such as: professional traffic tracking software, the newsletter management application, by saving in databases the various contact forms available on the site that are completed by users, through online questionnaires, etc. We use IP addresses to analyze browsing habits, administer the site, track user interests, and gather demographic information for internal use. All these aim to increase the ease of use of the site and publish information as relevant as possible for users’ interests.

9. RESTRICTED ACCESS AND (UN)SUBSCRIPTION

By accessing the site, creating a user account, and placing orders, the user expressly accepts the Terms and Conditions of the site, the way operations are conducted online as described on the site.

There are areas on the site that require registration (see Registration) or subscription (see Newsletter).

In the case of the newsletter, each edition/alert contains the method to unsubscribe; once this option is accessed, unsubscription applies immediately, no further confirmations from users are required. Depending on the type of operation (creating a site account, subscribing to the newsletter, applying for an online credit form, making a donation), the user may be asked for data such as: name, first name, email, address, phone number, CNP, company, etc.

Some requested data are mandatory to provide the good or service the customer is interested in. These data are used for identification, validation, or completion of the subscriber account.

Personal data will be used for the purpose of executing contracts and processing your orders. Subsequently, the data will be saved considering the retention periods according to fiscal and commercial legislation and as long as necessary to protect the rights of FIJI TRAILERS.

To properly execute the sales contract, after the customer has given their consent, FIJI TRAILERS may contact the customer, by phone or email if during site access they provide identification and contact data. At the time of order placement, the customer agrees with the subsequent communication form (phone or electronic) and the way the seller operates.

If you have entered your contact details but have not validated the user account, you may be contacted by a FIJI TRAILERS representative to complete this procedure by deleting the data if you no longer wish to become a user or by providing assistance and validating the account. This action is legally based on our legitimate interest in cleaning and updating the database.

If you have added products to the Shopping Cart but have not completed the order, you may be contacted by email or phone by a FIJI TRAILERS representative, notifying you that you forgot the products in the cart. This unique action is justified by the company’s interest in clarifying the situation by completing the sales contract or canceling it. After this action, the customer will be contacted if they have expressed their consent to receive other offers/commercial communications.

Within a reasonable period after purchasing a good or service (usually after 14 days in which the customer can return the product, withdrawing from the sales contract), the buyer may be contacted through the same communication channels agreed upon when placing the order, to provide feedback/review regarding the purchased good or service. Thus, the customer actively participates in creating new services and detailing the characteristics of goods and informing other potential buyers on the site. Your opinions are carefully analyzed by FIJI TRAILERS employees, who use them as a guide in choosing the products and range offered to customers.

In the “Recommend to a friend” application, the name and email address of the friend to whom you want to recommend a product/newsletter from FIJI TRAILERS will be requested. The application will automatically send an email message to your friend, inviting them to visit the site.

FIJI TRAILERS stores this information for the sole purpose of sending this unique email message. No other alerts/information will be sent to the friend’s address without their prior consent.

10. COOKIES

The site www.fijitrailers.com uses cookies, which are data stored on the user’s computer, mobile terminal, or other equipment, containing information about the user. Using the cookie mechanism is an advantage for visitors, allowing the storage of navigation options on the site such as the language in which the site is displayed, type of filters that apply to the display of certain pages, memorization of the username and password for quick access to the content of the site. Not accepting a cookie does not mean that the user will be denied access to browsing the site, reading its content. With the help of cookies, site owners can monitor and segment users’ interests towards certain areas or applications of the site, which subsequently allows improving the browsing experience, introducing relevant content for the user, etc.

Some of our business partners use cookies on our site, for example, those who advertise. However, we do not have access to or control over these cookies.

Cookies that, from a technical point of view, are not mandatory to be stored on the user’s terminal will be used only if the user expresses explicit and unequivocal consent regarding them, by checking the categories presented. This site contains links to other sites. MINCOS CONCEPT SRL is not responsible for the privacy policy practiced by these sites. We recommend that you consult in advance the legal terms and other information regarding the collection of personal data. The rules presented in this text apply only in the case of data collected on this site.

The page uses “plug-ins” from social network operators (e.g., www.facebook.com).

We use plug-ins to create a connection between the site www.fijitrailers.com and the official company page opened on Facebook (https://www.facebook.com/Japeto/). We do not collect/store customers’ personal data through the plug-ins, but it is possible that through this connection, customers can see on their Facebook accounts, some of their friends who like the Japeto page.

Although there is the possibility of contacting a Japeto representative/administrator of the Japeto page on the social network, requests for information related to order status, stock availability, technical characteristics of products, complaints, etc., should be directed to the Customer Relations Department, through the contact form provided on the site in the Support Clients section or at the phone numbers: 0734 954 336 / 0770 804 204 – callable from any network, in the country and abroad (normal rate). 12. LOYALTY PROGRAM BONUS CARD

To participate in this program, MINCOS CONCEPT SRL will process your data for the purposes presented in the program’s regulation and in compliance with the legal provisions regarding the processing of personal data. For further marketing communications and product offers, MINCOS CONCEPT SRL will ask for your explicit consent and will offer you the possibility to refuse such processing without affecting your ability to participate in the loyalty program.

13. NOTIFICATIONS AND ACTIONS REGARDING USER INFORMATION

At the written request of the users, dated and signed, sent to FIJI TRAILERS, it undertakes to:

Confirm to the applicant whether or not it processes personal data; this is done free of charge, once a year;
Rectify, update, block, delete, or transform into anonymous data, free of charge, data whose processing is not in accordance with the provisions regarding the protection of individuals with regard to the processing of personal data and the free movement of such data;
Transmit to the user the personal data that concerns them and that they have provided to MINCOS CONCEPT SRL in a structured format, used in common and which can be read automatically for the purpose of transmitting them to another operator;
Cease the processing of the user’s personal data, if the user requests this.
14. COMMUNICATION OF CHANGES

If the identification information of a user changes (such as the postal code) or if a user wishes to renounce our services, we will ensure that those personal data entrusted to us are corrected, updated, or deleted. This can be done either from the registration page or through the contact form https://www.fijitrailers.com/contact/.

Any change to the terms of this policy will be communicated to users by email so that they are always informed about the data we collect, how we use it, and under what circumstances, if any, we disclose it. Users will be able to agree or not with the use of the information for other purposes. 16. JURISDICTION. APPLICABLE LAW

The contractual relationships between the parties will be governed by Romanian law. Disputes that cannot be resolved amicably will be submitted to the competent courts for resolution.

Regulations of ongoing campaigns will be periodically published on the site; these describe in detail the special terms and conditions applicable to each campaign and complete the provisions of this document “Terms and conditions of use of the site www.fijitrailers.com.”
The promotions displayed will be valid for limited periods, specified on the product presentation page in the online store / special regulations and within the limits of available stocks.
The products, prices, and information regarding stock availability displayed on the site www.fijitrailers.com may differ from those displayed in FIJI TRAILERS stores (FIJI TRAILERS points of work in cities).
FIJI TRAILERS reserves the right to complete and/or modify any information published on the site without prior notice to the users of the site.
Legal entities and individuals can purchase a maximum of 6 products from each code. There is no limitation on the number of purchased codes. For corporate clients who wish to purchase more products of the same code, a personalized offer can be requested from the Business to Business division at the email address [email protected].

19. OUT-OF-STOCK

In case of stock exhaustion, the order will be canceled, the customer being notified in this respect by a representative of FIJI TRAILERS. For paid orders, the equivalent value will be refunded through the method or account from which the payment was made.

Note: Any unauthorized intervention on a FIJI TRAILERS product automatically voids the product’s warranty!
